Spotlane Terms of Service

General Provisions

These Terms of Service govern the use of the Spotlane service and mobile application (the "Application") made available by Łukasz Jagodziński, with its registered address at: ul. Sumakowa 10, 62-069 Palędzie, gm. Dopiewo (the "Operator").

The Application is a motoring community connecting drivers, car enthusiasts and meetup organisers. In particular it enables: publishing spots and places with reviews, keeping a profile and a garage, planning routes and meetups with meeting points and checkpoints, driving together with a live map and voice conversation, group chat and direct messages.

The Application is available as a mobile app and as a browser panel. Both channels use the same account and are governed by these Terms.

By using the Application you accept these Terms. If you do not agree, please do not use the Application.

Registration and User Account

Access to the full features of the Application requires creating an account (registration via email, Google, Apple or phone number).

You must be at least 16 years old or have parental/guardian consent.

You are responsible for keeping your login credentials confidential and for all activity carried out under your account.

Each user may hold only one account.

Accounts are non-transferable.

Acceptable Use

You agree to use the Application in accordance with the law, good practices and these Terms.

In particular, you must not:

a) publish illegal, offensive, discriminatory content or content that infringes the rights of third parties or intellectual property rights;

b) impersonate other individuals or entities;

c) send spam or unsolicited commercial messages;

d) use bots, scrapers or automated tools without the Operator's consent;

e) take actions that threaten the security of the Application or its infrastructure;

f) organise meetups, routes or activities that violate road traffic regulations or may endanger the safety of participants.

User Content

You retain ownership of the content you publish in the Application (photos, descriptions, posts, spots).

By publishing content, you grant the Operator a non-exclusive, royalty-free licence to display, store and distribute it within the Application.

The Operator may remove content that violates these Terms or applicable law without prior notice.

You are responsible for ensuring that your published content complies with the law and the rights of third parties (including portrait rights and copyright).

Meetups, Drives and Road Safety

Meetups and drives are organised by users. The Operator provides tools to plan and coordinate them — it is not the organiser, carrier or participant of those events and does not supervise them.

The driver is responsible for complying with road traffic regulations. The Application does not relieve you of that duty and must not be operated in a way that distracts you from the road — set your route before you start and use a hands-free kit or a phone mount while driving.

Using the Application to organise races, speed runs on public roads or other activities endangering safety is prohibited. Timing and telemetry features, where available, are intended for closed circuits and facilities only.

Joining a drive or an active meetup means sharing your live position with the other participants for the duration of the event. You can stop it at any time by leaving the event.

Voice Conversations and Chat

Meetup voice conversations serve to coordinate participants. They are not recorded by the Operator; recording and publishing a conversation without the knowledge of its participants is prohibited.

Meetup chat, groups and direct messages are subject to the same rules as all other content. Once a meetup has ended, its chat becomes read-only.

The Operator may restrict access to chat and voice for a user who breaches these Terms — in particular by harassing other participants or sending spam.

Photos, Likeness and Licence Plates

Photos uploaded to the Application go through automatic licence-plate blurring. The mechanism does its best but offers no guarantee of effectiveness — check the preview before publishing and do not upload photos whose publication could infringe someone's rights.

When you publish a photo showing identifiable people, you are responsible for having a legal basis to disseminate their image. At the request of the person concerned the content will be removed.

The Operator may verify the authenticity of uploaded files by technical means and remove content where there is reasonable suspicion of manipulation.

Reporting Content and Moderation

From within the Application you can report a user account, a spot, a place, an advertisement and a map hazard. You can also block another user — that hides their content and cuts off contact with you, including messages and chat.

Content that does not have a report button yet — direct messages, meetup and group chat, posts and comments — can be reported to us by email at [email protected]. We handle those the same way, just by a slower route.

We handle reports without undue delay. A breach may result in content removal, feature restrictions, suspension or deletion of the account — proportionately to the severity of the breach.

You may appeal a moderation decision by writing to [email protected]. Appeals are reviewed by a human, not by an automated system.

Advertising

The Application is free of charge and funded by advertising displayed in the mobile app.

In the settings you choose your ad mode: personalised (requires your consent) or non-personalised. Declining consent to personalisation does not restrict access to the Application's features.

Artificially generating ad impressions or clicks and interfering with ad delivery mechanisms is prohibited.

Availability and Changes to the Application

The Operator reserves the right to temporarily suspend the Application for maintenance purposes.

The Operator may modify features, restrict access to certain sections, or shut down the Application with 30 days' notice to users.

Liability

The Operator is not liable for:

a) content published by users;

b) actions taken by users outside the Application (meetups, drives);

c) service interruptions caused by infrastructure failures, force majeure or third-party interference;

d) the accuracy of location data or maps.

You use the Application at your own risk to the extent permitted by law.

Account Termination

You may request deletion of your account at any time — from the Application settings or by writing to us at [email protected]. We carry the request out within the period stated in the Privacy Policy and delete the data in line with it.

You can request a copy of your data at the same address; we provide it in the same way.

The Operator may suspend or delete accounts in case of a breach of these Terms.

Governing Law and Disputes

These Terms are governed by Polish law.

Any disputes arising from the use of the Application shall be submitted to the court with jurisdiction over the Operator's registered address, unless mandatory applicable law provides otherwise.

Changes to These Terms

We will inform you of significant changes to these Terms at least 14 days in advance. Continued use of the Application after that period constitutes acceptance of the changes.
